Terms of Use
Version 2026-10-28
In short
- Spotwin is a tool. It runs on your computer, and you decide what to search for and what to do with the results.
- You are responsible for following the laws that apply to you, and the terms of every website and service you reach through Spotwin, including Google’s.
- Your leads stay on your computer. The developer does not receive, store or sell them.
- Spotwin comes as it is, without guarantees. The developer’s liability is limited to what you paid.
1. This agreement
These Terms of Use are an agreement between you and the developer of Spotwin (“we”, “us”). They apply to every version of Spotwin, free or paid. By ticking the box and choosing “Agree and continue”, or by using Spotwin, you accept them. If you use Spotwin for a business, you accept them for that business and confirm you may do so.
If you do not agree, do not use Spotwin. Close it and uninstall it.
2. What Spotwin is
Spotwin is software that helps you look up publicly listed information about businesses from online sources, and organise it on your own computer as leads: contacts, notes, calls, follow-ups and similar records.
We do not provide, own, host, check or guarantee any of that information. It comes from third-party sources, at your request, to your computer.
3. Your responsibilities
You alone decide which searches to run, how often and how many, and how you store, use, share and act on what you find. You are fully responsible for that.
You must follow every law and rule that applies to you and to the people and businesses you contact. Depending on where you and they are, these can include data-protection laws (for example India’s Digital Personal Data Protection Act 2023, the EU and UK GDPR), rules on calls, messages and email (for example TRAI regulations and the Do-Not-Disturb registry in India, the US TCPA and CAN-SPAM Act, the UK PECR), anti-spam and consumer-protection laws.
You must follow the terms, policies and usage limits of every website and service Spotwin reaches on your behalf, including Google’s terms of service. If a source does not allow automated access, or limits it, it is your responsibility to respect that, or not to use Spotwin with it.
Where the law requires consent before contacting someone, get it. Honour every request to stop contacting someone, and check numbers against do-not-call registries where required.
Do not use Spotwin for spam, harassment, fraud, impersonation, stalking, discrimination, or for collecting information about private individuals rather than businesses. Do not resell or publish the information in breach of any law or third-party right.
4. Third-party sources and services
Spotwin connects from your computer, over your internet connection, directly to third-party services. They are not ours and we do not control them. They may change, limit, slow down or block access at any time, including for you or your internet address, and the information they return may be incomplete, out of date or wrong.
We are not responsible for third-party services, their content, their availability, or what they do in response to your use of them.
5. Your data
Everything you collect or type into Spotwin is stored on your computer. We do not receive it. You decide what it contains and how it is used, and you are responsible for it under data-protection law (for example as the “data fiduciary” or “controller”). Keep your own backups; we cannot recover lost data.
6. Your licence, plans and payment
We give you a personal, non-exclusive, non-transferable licence to use Spotwin under the plan you have. The free taste has the limits shown in the app. Spotwin Pro is sold through our online store, which handles payment, renewal, cancellation and refunds under its own terms, as an Annual plan (a yearly subscription) or a Lifetime plan (one payment). Lifetime means for as long as we offer and support Spotwin, not for your whole life.
Do not copy, resell, rent, or share Spotwin or a licence key, and do not remove or get around its licence checks.
Do not decompile, disassemble, reverse engineer or otherwise try to get at Spotwin’s source code, and do not use Spotwin or any part of it to build a competing product, except where the law expressly allows this despite these terms. Spotwin, its code, design and name belong to us and are protected by copyright and other laws.
We may change Spotwin, its features, its plans and its prices. Price changes apply from your next renewal, and you can cancel before it.
7. Open-source parts
Spotwin includes open-source software under its own licences, listed in the app under “Open-source licences”. Nothing in these terms limits the rights those licences give you.
8. No warranty
Spotwin is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, completeness, availability, non-infringement, or that any particular use is lawful where you are. You use it at your own risk.
9. Limit of liability
To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive loss, or for lost profits, revenue, data, goodwill or business, however caused.
To the fullest extent the law allows, our total liability for everything related to Spotwin is limited to the amount you paid us for Spotwin in the 12 months before the claim, or US$5 if you paid nothing.
10. Your promise to cover us
You agree to defend, indemnify and hold harmless us and anyone acting for us against every claim, demand, penalty, loss, cost and expense (including reasonable legal fees) arising from your use of Spotwin, the searches you run, the information you collect, the people and businesses you contact, or your breach of these terms, of any law, or of any third party’s terms or rights.
11. Ending this agreement
You can stop at any time by uninstalling Spotwin. If you break these terms, your licence ends automatically, and we may refuse or cancel your licence key. Sections 3, 5 and 8 to 13 continue after it ends.
12. Changes to these terms
We may update these terms. Spotwin will show you the new version, and you will need to accept it to keep using Spotwin.
13. Law, disputes and the rest
These terms are governed by the laws of India. Any dispute goes exclusively to the courts of India, unless the law where you live gives you a right that cannot be taken away.
If any part of these terms cannot be enforced, the rest still applies. These terms, with the Privacy Notice, are the whole agreement about Spotwin. Not enforcing a right is not giving it up.
Questions: use the contact option on the Spotwin page where you bought or downloaded it.
